DISEÑO Y EQUIPAMIENTO CON VALOR, S.A. DE C.V., under the trade name DEVA® México (hereinafter, "DEVA México"), with its address at Circuito Circunvalación Poniente No. 4B, Oficina 7, Ciudad Satélite, Naucalpan de Juárez, C.P. 53100, Estado de México, is the controller ("responsable") of the processing of your personal data pursuant to the Federal Law on the Protection of Personal Data Held by Private Parties ("Ley Federal de Protección de Datos Personales en Posesión de los Particulares", LFPDPPP), its Regulations ("Reglamento") and the Privacy Notice Guidelines ("Lineamientos del Aviso de Privacidad") (hereinafter, the "Law"). This notice informs you which data we obtain, what we use them for, who processes them on our behalf and how you can exercise your rights.

Personal data we process

We obtain your personal data in three ways:

Data you provide to us when you fill in the forms on this website, write to us at contacto@devamexico.com, call us or message us on WhatsApp: name, company, position, email address, phone number, sector or industry, the location of your warehouse and whatever information you choose to include about your operation and your project.

Data obtained automatically while you browse the site: pages visited, date, time and duration of the visit, the site or campaign that brought you to us, the type of device and browser, the language, the approximate city derived from your IP address, and the page and button from which you reached a form. The section "Cookies and measurement technologies on our website" details which technologies obtain them and how to disable them.

Data we obtain from publicly accessible professional profiles, today only from LinkedIn, for business-to-business commercial prospecting: name, company, position and professional contact details. Because we do not receive these data from you directly, we make this notice available to you at our first contact with you, in accordance with article 17 of the LFPDPPP and article 29, section I, of its Regulations.

We do not ask you for sensitive personal data or data of minors, and our forms have no field for them. The free-text fields are for describing your operation and your project; please do not include sensitive data in them. If you nevertheless include any, we keep it only to handle your request. If you write to us on WhatsApp, the conversation is also governed by WhatsApp's privacy notice (Meta Platforms); DEVA México keeps only what you write to us, in order to handle your request.

Purposes of the processing

Necessary purposes (they give rise to the relationship with you and do not require your additional consent):

  1. Handling your request for an assessment, a quote, information or contact, and following up on it.
  2. Preparing technical and commercial proposals and, where applicable, entering into and performing the corresponding contract.
  3. Keeping an internal record of the requests received, with the channel through which they reached us, so as to handle each one only once and measure the effectiveness of our communication.
  4. Complying with the applicable legal, tax and regulatory obligations.

Secondary purposes (they are not necessary to serve you; you may object to them at any time without this affecting your request):

  1. Sending you information about our products, services, news and content (commercial prospecting), whether you provided your data through this website or our contact channels or we obtained them from your professional profile on LinkedIn.
  2. Measuring the use of our website and improving our content and our communication (statistical analysis), under the terms of the cookies section.

If you do not want your data to be processed for purposes 5 or 6, you may say so at any time by writing to direccionadmin@devamexico.com (purpose 5) or through the cookie notice and the "Cookie preferences" link in the footer (purpose 6). To process your data for a purpose other than those stated here, we will ask for your consent again.

Who processes your data on behalf of DEVA México

We do not sell your personal data. Today we do not transfer them to third parties for those third parties' own purposes; those who process them on our behalf are the processors ("encargados") named in this section. If we incorporate a new service or an advertising tool that processes your data, we will update this notice and our Cookie Policy before it is activated. To operate this site and handle your requests we rely on providers that process the data solely on our behalf and in accordance with our instructions, as processors:

Netlify, Inc. (United States of America): hosting of the website and receipt and safekeeping of the submitted forms.

Google LLC (United States of America): Google Analytics for site measurement (see the cookies section) and Google Workspace for the internal record of the requests received and DEVA México's email.

Storyblok GmbH (Austria): management of the site's content and delivery of the site's images from Storyblok's content-delivery network, which receives your browser's IP address when it delivers each image to you.

These providers may process the information on servers located outside Mexico, under contracts that oblige them to protect it and to use it only to provide the service to us. Apart from these cases, we will disclose your data only to competent authorities when a legal provision or a duly founded and reasoned order so requires.

How to limit the use or disclosure of your data

In addition to objecting to the secondary purposes, you may ask to be added to our internal exclusion list so that you do not receive commercial communications, by writing to direccionadmin@devamexico.com. As regards cookies and measurement, the means to disable them are described in the corresponding section of this notice and in our Cookie Policy.

You have the right to know which personal data we hold about you, what we use them for and under what conditions (Access); to request their correction when they are inaccurate, incomplete or out of date (Rectification); to have us delete them from our records when they are no longer necessary for the purposes of this notice or you consider that they are not processed in accordance with the Law (Cancellation); and to object to their processing for specific purposes (Opposition); together, these are the ARCO rights (access, rectification, cancellation and opposition). You may also revoke at any time the consent you have given us; please note that for some necessary purposes the revocation may mean that we can no longer continue handling your request or providing the service to you.

To exercise any of these rights, send your request to direccionadmin@devamexico.com, stating your name, a means of communicating our response to you, the documents that prove your identity (or that of your representative) and a clear description of the data and of the right you wish to exercise. You may also submit it at our address. We will communicate our decision to you within a maximum of twenty business days from receipt of the request and, if it is granted, we will carry it out within the following fifteen business days; these periods may be extended once, for an equal period, when the circumstances so justify, of which we will inform you. Exercising these rights is free of charge; only the justified costs of shipping or reproduction may be charged. The person or department that handles these requests is Eva Karina Parra Nieves.

If you consider that your right to the protection of personal data has been violated, you may turn to the Secretaría Anticorrupción y Buen Gobierno (Mexico's data protection authority), the competent authority in this matter.

Security measures

DEVA México applies reasonable administrative, technical and physical measures to protect your personal data against damage, loss, alteration, destruction, or unauthorized use, access or processing, and requires equivalent measures from its processors.

Cookies and measurement technologies on our website

In compliance with the LFPDPPP and its Regulations, we inform you that our website uses cookies and similar technologies (browser local storage) through which the "browsing data" mentioned in this notice are obtained automatically. Below we describe which technologies they are, which data they collect, for what purpose, who processes them and how you can disable them.

Measurement technologies (Google Analytics 4). We use the Google Analytics 4 service, which, when measurement is active, sets in your browser the cookies _ga and _ga_* (the latter followed by the identifier of our Google Analytics property), with a duration of up to 24 months from your last visit. These cookies contain a random identifier that distinguishes your browser from others; they do not contain your name, your email address or any data you type into our forms. Through them the following data are obtained: pages visited, date, time and duration of the visit, website or campaign from which you reached our site, type of device, browser, operating system and language, approximate city-level location estimated from your IP address, and the fact that a contact or assessment form was submitted (without the content of the form). These are pseudonymized data: on their own they do not allow us to identify you, and we do not associate them with the contact details you provide to us.

Purposes. These data are used exclusively to measure the traffic of our website, to know which campaigns or sites each visit comes from (attribution) and to count how many visits end in a contact or assessment request (conversions), in order to improve our content and our communication. They correspond to the statistical analysis purpose stated in this notice. We do not use Google Analytics to show you personalized advertising or for remarketing: we have disabled Google Signals and ads personalization, so the information is not linked to your Google account and is not used to build advertising profiles.

Data processor. Google Analytics is a service of Google LLC, with its address at 1600 Amphitheatre Parkway, Mountain View, California 94043, United States of America, which processes these data on behalf of DEVA México and in accordance with our instructions, as a processor, under the Google Analytics data processing terms. Google may process the information on servers located outside Mexico. You can read how Google uses information from sites that use its services at https://policies.google.com/technologies/partner-sites and its privacy policy at https://policies.google.com/privacy. This transmission ("remisión") of data to a processor does not constitute a transfer of your personal data to a third party for its own purposes.

Activation depending on your location. The Google Analytics script loads on every page of the site, but it only sets cookies and records your browsing in an identifiable way when measurement is active. For visitors located in the European Union, the European Economic Area, the United Kingdom or Switzerland, no measurement cookie is set until they expressly accept it in the cookie notice. For visitors from the rest of the world, Mexico included, measurement cookies are set from the first visit, under the terms of the Law, and measurement can be turned off at any time as indicated below. While measurement is turned off, no Google Analytics cookie is set; the browser may still send Google cookieless signals (the address of the page visited, the referring site and the status of your choice, together with the IP address inherent in every internet connection), which Google uses only for aggregate counts and which do not make it possible to identify you or track your browsing.

DEVA México's own storage. In addition, our site stores the following items in your own browser. They are not sent to Google; only when a form is submitted does Google Analytics receive the source channel of the visit (for example, "organico"), and the page and button from which you reached the form, without any personal data.

  • deva_consent: a cookie that remembers your choice about cookies (yes or no, and the date you made it) so as not to show you the notice again. Duration: 12 months.
  • deva_attr: a record in the browser's local storage with the source of your visit (the page through which you entered, the referring site, utm campaign parameters and, where present, the click identifier of a Google ad). It is kept for 180 days from your last visit and is sent to DEVA México only inside a form you choose to submit, so that we know through which channel your request arrived.
  • deva_cta and deva_pending_lead: temporary session records with the page and button from which you reached a form and with a note that you have just submitted it, so as to count each request only once. They are deleted when you close the tab or the browser.

How to disable these technologies. You can prevent or stop measurement at any time by any of these means:

  • In the cookie notice shown on your first visit, by clicking "Reject", or by clicking "Configure", switching off the "Analytics and measurement" category and clicking "Save preferences".
  • Later on, through the "Cookie preferences" link that appears in the footer of every page of the site, which reopens the settings panel. Once you reject measurement, from that moment on no Google Analytics cookies are set and your browsing is not recorded in an identifiable way; the browser may still send Google the cookieless signals described above. Cookies already set can be deleted from your browser settings.
  • In your browser settings, by blocking or deleting the cookies and local storage of devamexico.com, or by installing the Google Analytics opt-out browser add-on available at https://tools.google.com/dlpage/gaoptout.

Rejecting or disabling measurement does not affect the operation of the site or the submission of your requests. Detailed information on each cookie can be found in our Cookie Policy. The ARCO rights and the revocation of consent described in this notice also apply to the data obtained by these means and may be exercised through direccionadmin@devamexico.com.

Changes to this notice

This notice may change because of new legal provisions, changes in our products, services or privacy practices, or other causes. Any change will be published on this same page, www.devamexico.com/en/privacy, with its update date; when the change materially affects the purposes or the data processed, we will also notify you through the contact channel you have provided to us. You may ask us at any time whether the notice has changed by writing to contacto@devamexico.com.
